Dallas Father who drowned own children punished with Sentenced to death by a Dallas County jury. Dallas County jury has decided as early as Thursday whether to send a 34-year-old man to death row for drowning his young sons in a smelly, shallow creek to get back at their mother.

Closing arguments in the trial’s punishment phase are set to begin Thursday morning in the capital murder case of Naim Rasool Muhammad. He was convicted of capital murder last week for killing his sons, Naim, 5, and Elijah, 3. The only other sentencing option for the jury is life without parole.

Muhammad drowned the boys in August 2011 after abducting them and their mother as they walked to school near Fair Park on what would have been Naim’s first day of kindergarten. The mother escaped and sought help from a constable who was nearby. But Muhammad killed the boys as police searched for them.

In a video of his confession that was played during the trial, Muhammad said he told Naim and Elijah to pretend they were swimming; then he held their heads under the water until they stopped moving.

Muhammad, who had said he would testify, decided Wednesday not to do so.

Dallas County prosecutors Tammy Kemp, Sherre Sweet, Josh Healy and Patrick Kirlin are asking jurors to sentence Muhammad to death because, they say, he would be a danger even if he lived out his life in prison.

Defense attorneys Paul Johnson, Kobby T. Warren and Mark Watson want jurors to spare Muhammad’s life because of his upbringing.

Testimony has shown that Muhammad had a crack-addicted prostitute mother and was exposed to frequent violence in the home. Also, the defense says, the Dallas school district failed to provide special education services after he showed symptoms that, if not treated, could lead to an anti-social personality disorder. Generically, someone with anti-social personality disorder is known as a sociopath, according to testimony.

Muhammad has a history of violence against his son’s mother, Kametra Sampson, and one of his own sisters.

His attorneys also say Muhammad feared his sons’ childhood would be similar to his because Sampson began using cocaine and working as a prostitute after breaking up with Muhammad in December 2010. She went to drug treatment before the boys were murdered.

Also on Wednesday, visiting state District Judge Quay Parker, who is presiding, released from jail Muhammad’s sister, who had been held in contempt of court the previous day. Sekinah Muhammad, 29, was arrested after showing up late for court, breaking down on the witness stand and screaming in the hallway as she tried to take off her clothes.

Parker said he would drop the contempt citation if there were no more outbursts. Sekinah Muhammad promised there wouldn’t be and apologized, saying she had “an emotional breakdown.”

Naim Muhammad and Sekinah Muhammad both sobbed loudly in the courtroom as she testified this week about their childhood. Their mother often couldn’t raise them, and the siblings were split up and stayed with family or friends. One of the children, who is now deceased, also sexually abused some of the siblings, according to testimony.

Sekinah Muhammad also testified that her brother hit her twice on the head with a hammer in 2009. She did not want him to serve prison time, and he was on probation for that assault when he killed his children.
